SigParser Privacy Policy

Introduction

Dragnet Technologies, Inc. d/b/a SigParser (“we”, “us”, “our”) is committed to respecting your privacy and protecting your information.

This Privacy Policy (“Policy”) describes the types of information we may collect from you or you may provide to us when you visit our website www.sigparser.com (the “Site”). If you subscribe to our Services, then additional data privacy protections apply and these are set forth in our Terms of Service (“TOS”) and/or Data Processing Agreement (“DPA”).

This Policy is specifically applicable to information that (a) we collect from Site visitors, and (b) you provide so we may conduct business with you. When we collect or you provide us with such information (“Customer Information” as defined below), we are acting as a data controller for purposes of Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 (“GDPR”). We collect, use, and store Customer Information in compliance with this Policy and GDPR.

This Policy is not generally applicable to email data you submit to our Services for parsing. When our Services parse email data (“Customer Data” as defined below), we are acting as a data processor for purposes of GDPR. We process Customer Data in accordance with the TOS and/or DPA. Our TOS and DPA contain data confidentiality and security provisions more stringent and comprehensive than those set forth in this Policy.

Please read this Policy carefully. It sets forth the basis for our collection and use of Customer Information that contains personal data. By using our Site or providing us with information, you are accepting and consenting to the practices described in this Policy.

Customer Information versus Customer Data

We define “Customer Information” as information (including personal data) that: (a) we collect when you visit our Site, (b) you provide to us as a result of online or offline interactions, and (c) we may compile from third party sources. Examples of such information include your name, title, company name, contact details, business information, payment information, and IP address. We administer your account, provide support, and improve our Site using Customer Information in compliance with this Policy.

We define “Customer Data” as the email information (including personal data) you provide to our Services for parsing, transfer, and storage. When you link an email account to our Services, or submit bulk email data to our Services, you are providing us with Customer Data. Our Services process and store Customer Data under the direction and control of our Customers. We do not disclose, share, or sell Customer Data.

If you link your Gmail account (or any other email domain/server) to the Services, the information you provide constitutes Customer Data. As such, it is strictly confidential and will be used only for the purposes set forth in the TOS. As a result of the foregoing, our use of information received from Google APIs (e.g., Gmail) adheres to Google API Services User Data Policy, including the Limited Use requirements.

We collect and use the Customer Information described below in order to provide you with access to our Site and administer our Services in a reliable and secure manner. We also collect and use such personal data:

  • Where necessary for us to fulfil our contractual obligations to you or your company;
  • Where necessary for us to carry out your instructions;
  • To comply with our legal obligations;
  • For our legitimate business needs; and
  • Because you have expressly given us your consent.

Information You Provide

You may give us the following information when you ask us to contact you for business purposes, register for marketing information, subscribe to the Services, correspond with us by phone, email or otherwise, or when you seek support from us:

  • Identity and contact data including your name, address, email address, company name, telephone number, job title and function; and
  • Business information provided during the course of the contractual relationship between you or your company and us.

Information We Collect

When you visit our Site, we may automatically collect the following information:

  • Technical information, including the Internet protocol (IP) address used to connect your computer to the Internet and our Site, your login information, browser type and version, time zone setting, browser plug-in types and versions, operating system and platform; and

  • Information about your visit, including the full Uniform Resource Locators (URL) clickstream to, through and from our Site (including date and time); products you viewed or searched for; page response times, download errors, length of visits to certain pages, page interaction information (such as scrolling, clicks, and mouse-overs), and methods used to browse away from the page and any phone number used to call our customer service number.

Information about Others

If you provide us with information about anyone else, for example your officers, employees, managers, agents, advisers, customers, or suppliers (collectively, “Customer Parties”), you must ensure they understand how their information will be used, they have given their permission for you to disclose it, and they have consented to its use by us. By providing information and personal data of Customer Parties, you represent to us that you have permission, consent and/or the legal right to do so.

If we receive a request regarding personal data from any Customer Parties, then, unless required otherwise by applicable law or agreement, we will refer such request to the Customer. Persons that have submitted their personal data to our Customers, and which such information has been transferred to us, should contact Customer in the first instance to correct, update, or request deletion of their personal data.

Automated Decision Making

We do not use Customer Information that includes personal data to make any automated decisions.

We use cookies to distinguish you from other users of our Site and to optimize the performance of the Site. Please see our Cookie Policy for further details.

Uses of Customer Information

(1) Information you provide to us is used to:

  • Register you for marketing contact, Services information, or a free trial;
  • Register you and your company as a Services subscriber or Customer;
  • Carry out our obligations arising from any contracts entered into between you and us, and provide and administer support services to you and your company;
  • Administer and manage our business relationship with you, including billing, payment, and accounting;
  • Comply with our legal obligations and keep records of our compliance processes;
  • Exercise or defend our legal rights, or comply with court orders; and
  • Inform you about changes to the Services that may affect you or your company.

(2) Information we collect about you is used to:

  • Improve our Site to ensure that content is presented in the most effective manner for you and your computer; and
  • Keep our Site safe and secure.

(3) Information we receive from other sources is used to:

We may combine this information with information you give to us and information we collect about you. We may use this information and the combined information for the purposes set forth above (depending on the types of information we receive).

Disclosure of Your Information

(1) Information we share with third parties We may share your information with selected third parties including:

  • Business partners, suppliers, vendors, and sub-contractors for the performance of any contract we enter into with them or you; and
  • Analytics and search engine providers who assist us in the improvement and optimization of our Site.

(2) Information we disclose to third parties

We may disclose your information to third parties:

  • If we sell or buy any business or assets, in which case we may disclose your personal data to the prospective seller or buyer of such business or assets;
  • If SigParser or substantially all of its assets are acquired by a third party, in which case personal data held by us will be one of the transferred assets; and
  • If we are under a duty to disclose your personal data to comply with any legal obligation, or in order to enforce or apply our TOS and/or any other agreements; or to protect our rights, property, safety, Customers or others. This includes exchanging information with other companies and organizations for the purposes of fraud protection, anti-money laundering, and credit risk reduction.

(3) Transfer of Information

We engage service providers who may transfer your information to countries outside of your country of residence. These countries may have data protection rules that are different from those of your country of residence. The personal data that we collect from you may therefore be transferred to, and stored at, a destination outside the EEA. It may also be processed by staff operating outside the EEA who work for one of our partners or suppliers. Such staff or subcontractors maybe engaged in, among other things the provision of hosting services or sub-processing services. By submitting your personal data, you agree to this transfer, storing or processing outside of the EEA.

We will take all steps reasonably necessary to ensure that your data is treated securely and in accordance with this Policy. In particular, this means that your personal data will only be transferred to a country that provides an adequate level of protection (for example, where the European Commission has determined that a country provides an adequate level of protection) or where the recipient is bound by agreements with us that comply with GDPR. These agreements may restrict such transfers to the EEA or include the EU Standard Contractual Clauses.

Protection of Information

All information you provide to us is stored on secure devices and/or systems. We have put in place appropriate security measures to prevent your personal data from being accidentally lost, used, altered, disclosed, or accessed in an unauthorized way. While no security is impenetrable, we implement and maintain commercially appropriate technical, physical, administrative, and organizational measures to ensure a level of security appropriate to the risk for handling your information. We have implemented physical and technical safeguards, online and offline, to protect information from loss, misuse, and unauthorized access, disclosure, alternation, or destruction. Despite these precautions, no data security safeguards guarantee 100% security. We have put in place procedures to deal with any suspected personal data breaches and will notify you no later than 72 hours after we become aware of any such breach. We will notify any applicable regulator or supervisory authority of a personal data breach where we are legally required to do so.

Our Site contains links to and from other websites, products, and services. Clicking on those links may allow third parties to collect or share data about you. If you follow a link to any of these websites, please note that these websites have their own privacy policies and we do not accept any responsibility or liability for these policies. Please check these policies before you submit any personal data to these websites.

Your Rights

You have the right under GDPR and applicable data protection laws, free of charge, to:

  • Request access to your personal data;
  • Request rectification or deletion of your personal data;
  • Request a restriction on the processing of your personal data;
  • Object to the processing of your personal data;
  • Request deletion of your personal data; and
  • Request a transfer of some of your personal data (data portability).

You can make a request in relation to any of the above rights by contacting us and providing appropriate proof of your identity, such as copy of your driver’s license, passport, or government-issued identification. We will respond to such requests within 30 days and process requests we receive from you in accordance with applicable data protection law(s).

We have appointed IT Governance Europe Limited to act as our EU representative. If you wish to exercise your rights under the EU General Data Protection Regulation (EU GDPR) or have any queries in relation to your rights or general privacy matters, please email our Representative at eurep@itgovernance.eu. Please ensure to include our company name in any correspondence you send to our Representative.

You have the right to withdraw your consent to the collection, processing and transfer of your personal data, at any time, by contacting us as set forth below.

Marketing

We will process your personal data for the purposes of scheduling a demonstration or providing you with a free trial. We will only contact you if you register on our Site to receive a demonstration or free trial, or if you purchase any of our products or Services. If you register on our Site for any of these reasons, we will inform you and obtain your “opt in” consent before we collect and use your personal data for such purposes. You can ask us to stop sending you emails at any time by clicking the “unsubscribe” link at the bottom of any email or contacting us as set forth below. Once you do this, you will no longer receive any emails from us. However, we will continue to communicate with you regarding provision of our Services if you are an active subscriber or Customer.

Data Retention

We retain personal data for as long as necessary to fulfil the purpose for which it was provided or collected, which includes complying with any legal, accounting, regulatory, or reporting requirements. We may also retain personal data where reasonably necessary to comply with our legal obligations (including law enforcement requests), to meet regulatory requirements, maintain security, prevent fraud and abuse, resolve disputes, enforce our TOS or any other agreement with you, or fulfil your request to “unsubscribe” from further messages from us.

Age of Users

This Site is not intended for and we do not provide any Services to persons under the age of 18.

Your California Privacy Rights

California Civil Code Section § 1798.83 permits users of our Site that are California residents to request certain information regarding our disclosure of personal data to third parties for their direct marketing purposes. In compliance with California AB 370, Section 22575, we have a responsibility to inform you that the Site does not take any specific automated action in response to browser “Do Not Track” signals or similar mechanisms (“DNT Signals”). As noted in the Cookie section above, there are certain actions that visitors can take to restrict or eliminate the use of tracking technologies within the Site, however no actions are taken automatically in response to DNT Signals.
